Terms of Service

The service

Proofsy.io is a hosted software-as-a-service platform that enables users to collect, manage, and display testimonials.

The service is provided “as is” and “as available.” We do not guarantee that:

  • The service will be uninterrupted or error-free.

  • Testimonials collected through the platform are accurate, lawful, or complete.

  • Use of the service will result in increased sales, trust, or business outcomes.

Proofsy.io does not verify, endorse, or validate testimonials or other content submitted through the platform.

Eligibility and accounts

To use Proofsy.io:

  • You must be at least 16 years old.

  • You may create an account as an individual or on behalf of a business.

  • You are responsible for ensuring that all information provided is accurate and up to date.

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials.

  • All activity that occurs under your account.

Proofsy.io is not liable for any loss or damage resulting from unauthorized access caused by your failure to secure your account.

Account access and termination

You may cancel your subscription at any time through your account settings.

We reserve the right, at our sole discretion, to:

  • Suspend or terminate your account.

  • Restrict access to features.

  • Remove content associated with your account.

This may occur immediately and without prior notice if:

  • You violate these terms.

  • Your use of the service is unlawful, abusive, or fraudulent.

  • We are required to do so by law or regulatory authorities.

Plans, pricing, and changes

Proofsy.io offers multiple subscription plans, including free and paid plans. Details about current plans, pricing, and included features are available on our website. For the most up-to-date information, please visit the Pricing section via the pricing link in the top navigation bar.

  • Paid subscriptions are billed monthly.

  • Prices may change from time to time.

If pricing changes:

  • Existing subscribers will be notified at least 30 days in advance.

  • Changes apply from the next billing cycle after the notice period.

Continued use of the service after a price change constitutes acceptance of the new pricing.

Payments and billing

  • Payments are processed via Stripe.

  • Subscriptions renew automatically unless cancelled before the renewal date.

  • All fees are non-refundable, including for partial billing periods or unused time.

If a payment fails:

  • Access to paid features may be restricted or suspended.

  • Continued non-payment may result in account termination.

User content and responsibility

Users may upload or submit content, including but not limited to:

  • Logos and branding assets.

  • Testimonials, text, images, videos, profile information, and other materials submitted by users or their clients.

By submitting content, you confirm that:

  • You have the legal right and authority to submit the content.

  • Any third-party personal data has been collected lawfully and with appropriate consent.

  • The content does not violate applicable laws or third-party rights.

You acknowledge and agree that:

  • You are solely responsible for all content submitted through your account.

  • Proofsy.io does not review, moderate, or verify content.

  • Proofsy.io is not liable for claims arising from user-submitted content, including testimonials.

We reserve the right to remove or disable access to content that violates laws or these terms.

You grant Proofsy.io a non-exclusive, royalty-free, worldwide license to host, store, process, and display your content solely for the purpose of operating and providing the service.

Testimonials specifically about Proofsy.io may be used by us for marketing and promotional purposes.

Acceptable use

We may share your data with third-party service providers to operate the platform and fulfill the purposes above. These include:

  • Wix: website management

  • Stripe: payment processing

  • Google Analytics: analytics and usage tracking

  • Bolt: to store and serve your data

Notes:

  • We only share data required to provide the service.

  • Data may be transferred outside the EU/EEA. We ensure appropriate safeguards, such as Standard Contractual Clauses, are in place.

  • We do not sell personal data to third parties.

Client data, widgets, and data protection roles

Proofsy.io allows users to collect testimonials from their clients and display them, including through embedded widgets on third-party websites.

For such data:

  • You act as the data controller for all client data you collect.

  • Proofsy.io acts solely as a data processor, processing data on your behalf to provide the service.

You are responsible for:

  • Obtaining valid consent or another lawful basis to collect and publicly display client data.

  • Ensuring testimonials displayed via widgets comply with applicable laws.

Proofsy.io does not control where or how widgets are embedded and is not responsible for the use or disclosure of client data resulting from your embedding choices.

Embedded widgets and public display

Testimonials collected through Proofsy.io may be displayed publicly through embedded widgets on websites or other platforms.

By enabling or embedding widgets, you acknowledge that:

  • Client data included in testimonials may become publicly accessible.

  • You have obtained consent for such public display.

  • Proofsy.io does not control where or how embedded widgets are displayed once deployed by you.

Availability and support

Proofsy.io does not guarantee uptime, availability, or uninterrupted service.

  • The service may be unavailable due to maintenance, updates, or technical issues.

  • We may modify or discontinue parts of the service at any time.

We do not guarantee response times or resolution outcomes.

Disclaimer of warranties

To the maximum extent permitted by law, Proofsy.io is provided “as is” and “as available”, without warranties of any kind, whether express or implied.

We expressly disclaim any warranties of:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or reliability of testimonials or content

Limitation of liability

To the maximum extent permitted by law:

  • Proofsy.io shall not be liable for any indirect, incidental, consequential, or special damages.

  • Proofsy.io shall not be liable for loss of profits, data, goodwill, or business interruption.

Our total liability for any claim related to the service shall not exceed the amount paid by you to Proofsy.io in the 12 months preceding the claim, or zero if no fees were paid.

Indemnification

You agree to indemnify and hold harmless Proofsy.io from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the service.

  • Content submitted through your account.

  • Your violation of laws or third-party rights.

  • Your handling of client personal data.

Governing law and jurisdiction

These terms are governed by the laws of the Netherlands.

Any disputes shall be exclusively submitted to the competent courts in Arnhem, Netherlands.

Changes to these terms

We may update these terms from time to time.

  • Material changes will be communicated by email.

  • Non-material changes will be posted on the website with an updated effective date.

Continued use of the service after changes take effect constitutes acceptance of the updated terms.
